PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THE ZENTIEN SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS OF SERVICE. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Zentien LLC, a Florida limited liability company ("Zentien," "we," "us," or "our"), governing your access to and use of the Zentien platform, website, APIs, and related services (collectively, the "Service").
By creating an account, clicking "I agree," or otherwise accessing or using the Service, you represent that: (a) you have read and understood these Terms; (b) you are at least 18 years of age; and (c) if you are accepting on behalf of an organization, you have the authority to bind that organization to these Terms.
Zentien is a software-as-a-service (SaaS) platform that provides log aggregation, error monitoring, and diagnostic tooling for software development teams. The Service allows users to connect applications, APIs, and third-party integrations to collect, analyze, and visualize log and error data in real time.
The Service is currently in beta. Features, functionality, and availability may change at any time without notice. We make no commitment to any specific feature set, uptime level, or release schedule during the beta period.
To access the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to: (a) use a strong, unique password for your account; (b) notify us immediately of any unauthorized use of your account; and (c) not share your credentials with any third party. We are not liable for any loss or damage arising from your failure to maintain account security.
The Service is intended for use by businesses and professional developers. You may not create an account if you are under 18 years of age or if a prior account of yours has been terminated for cause.
You may use the Service solely for lawful purposes and in accordance with these Terms. Permitted use includes connecting your own applications to the Service to monitor logs and errors for development and operational purposes.
You agree not to use the Service to:
You are solely responsible for all data, logs, and content you submit to the Service. You represent and warrant that you have all necessary rights and permissions to submit such data, and that doing so does not violate any applicable law, regulation, or third-party rights.
The Service may allow you to connect third-party platforms, APIs, and services (such as Salesforce, Azure DevOps, or other tools) to route data through Zentien. These integrations are provided for your convenience. Zentien is not responsible for the availability, accuracy, or security of any third-party service.
By connecting a third-party integration, you represent that you have the authority and all necessary permissions to route data from that system through the Service. You are responsible for ensuring that such routing complies with the terms of service of those third-party providers and with applicable law.
The Service, including all software, algorithms, interfaces, designs, logos, trademarks, and documentation, is owned by Zentien LLC and is protected by applicable intellectual property laws. These Terms do not grant you any ownership interest in the Service. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely as permitted by these Terms.
You retain all ownership rights in the data, logs, and content you submit to the Service ("User Data"). By submitting User Data, you grant Zentien a limited, non-exclusive, royalty-free license to process, store, and display your User Data solely as necessary to provide the Service to you. We do not claim ownership of your User Data and will not sell it to third parties.
If you provide suggestions, feedback, or ideas regarding the Service, you grant Zentien a perpetual, irrevocable, royalty-free license to use that feedback without any obligation or compensation to you.
The Service is currently offered free of charge during the beta period. We reserve the right to introduce paid plans at any time. We will provide reasonable advance notice before transitioning any features from free to paid tiers. If and when paid plans are introduced, separate pricing terms will be presented at the time of purchase. All fees are non-refundable unless otherwise specified or required by applicable law.
THE SERVICE IS CURRENTLY IN BETA. IT IS PROVIDED FOR EVALUATION AND TESTING PURPOSES. FEATURES MAY BE INCOMPLETE, UNSTABLE, OR SUBJECT TO SIGNIFICANT CHANGE. DO NOT USE THE BETA SERVICE AS YOUR SOLE OR PRIMARY LOG STORAGE OR MONITORING SOLUTION FOR PRODUCTION-CRITICAL SYSTEMS.
During the beta period:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Zentien does not warrant that: (a) the Service will meet your requirements; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) any data processed by the Service will be accurate or complete; or (d) any errors in the Service will be corrected.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ZENTIEN LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, OR CONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL; DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; OR DAMAGES ARISING FROM YOUR RELIANCE ON THE SERVICE FOR PRODUCTION OR CRITICAL OPERATIONS.
TO THE EXTENT LIABILITY CANNOT BE FULLY EXCLUDED UNDER APPLICABLE LAW, ZENTIEN'S TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO ZENTIEN IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
You agree to indemnify, defend, and hold harmless Zentien LLC and its members, officers, employees, agents, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of the Service; your violation of these Terms; your violation of any applicable law or regulation; your violation of any third-party rights; or any User Data you submit.
These Terms are effective from the date you first access the Service and continue until terminated. You may terminate your account at any time by contacting us. We may suspend or terminate your access at any time, with or without cause. Upon termination, your right to use the Service will immediately cease. Sections 6, 9, 10, 11, 13, and 14 shall survive termination.
These Terms shall be governed by the laws of the State of Florida, without regard to its conflict of law principles. Any dispute not resolved within 30 days of good-faith negotiation may be pursued in the state or federal courts located in Miami-Dade County, Florida. You and Zentien agree to bring claims only in an individual capacity, not as part of a class action.
These Terms, together with the Privacy Policy and any Beta Terms, constitute the entire agreement between you and Zentien with respect to the Service. We reserve the right to modify these Terms at any time with at least 14 days' notice of material changes via email or prominent notice in the Service. If any provision is found unenforceable, the remaining provisions remain in effect. You may not assign your rights under these Terms without our prior written consent.
